The Missouri Supreme Court ruled Tuesday that an amendment that would enshrine abortion access in the state's constitution can appear on the general election ballot.

Missouri Supreme Court judges overturned Cole County Judge Christopher Limbaugh’s decision to remove the proposed constitutional amendment from the Nov. 5 ballot.

The swift decision by the Missouri Supreme Court followed several 11th hour attempts by Republican politicians to keep the proposal off the ballot.

Missouri Secretary of State John Ashcroft is now rejecting the petition previously certified that put the state’s abortion amendment on the Nov. 5 ballot.

Judge Bruce Romanick in Bismarck found that the state constitution protects women's right to an abortion before the fetus is viable, siding with abortion providers challenging the ban. The order is expected to take effect within 14 days.
